What to do after a bicycle accident in Virginia.
- Get medical care right away. Adrenaline hides injuries, and head and orthopedic injuries can be worse than they feel at the scene.
- Preserve the bike and your helmet. Do not repair or throw anything out. They are evidence of what happened.
- Document the road and the driver. Photos of the scene, the driver’s information, and the police report number all matter.
- Do not give the insurer a recorded statement before you talk with a lawyer. Under Virginia law you have the same right to the road as a car.
- Know the contributory-negligence trap. Virginia is one of the few states where, if the insurer pins even 1% of the fault on you, you can recover nothing. They will argue you “weren’t visible” or “ran the sign” to zero out your claim, which is exactly why early legal help matters.
