Sometimes, yes. Emotional harm can be part of an injury claim when another person’s conduct caused it. The answer turns on how the harm happened and what the proof shows. This page explains the main rules in plain words.

Emotional distress often follows a car crash, a truck crash, a serious brain or spinal cord injury, or the death of a loved one. Correll Law Firm handles these cases from its Winchester and Harrisonburg locations. It serves people across the Shenandoah Valley, Richmond and Henrico County.

What counts as emotional distress in a Virginia injury claim?

Emotional distress is mental and emotional harm. It can include fear, anxiety, grief, depression or trauma. People often use phrases like “pain and suffering” loosely. In this article, emotional distress means the psychological harm itself.

That harm can be part of a personal injury claim when it follows from negligence. Virginia’s high court describes a negligence claim as needing a legal duty, a breach of that duty, and proximate causation resulting in damage (The Atrium Unit Owners Ass’n v. King).

The court explained this in Ford Motor Co. v. Boomer. A claim has to connect the conduct to the harm.

If you were hurt or lost someone in a crash, you may have a claim, and you don't have to work out the next steps alone. It may be possible when a careless act causes a physical injury, or when a death results from a wrongful act. In most of these claims, the mental harm grows out of the physical injury. A head injury or a broken back can bring emotional symptoms with it, and a documented injury makes the link easier to explain.

Willful or wanton conduct is a second path. It is covered below.

Being upset, embarrassed or offended is a normal reaction. A claim usually needs more. It needs a real injury or death, a clear link to someone’s conduct, and proof of the harm.

How hard is it to prove emotional distress?

Proof is the hard part. Every injury and every crash is different, and the specific facts of a situation matter.

Medical records are a common form of proof. Counseling notes, prescriptions for anxiety or sleep problems, and visits to a mental health provider can all show the harm. Doctors may also record changes in sleep, appetite or the ability to work or drive.

Research helps explain why emotional symptoms often appear after brain injuries. A peer-reviewed study of concussion symptoms describes cognitive, physical, emotional and sleep symptoms after a concussion. It also notes that these symptoms can affect work or school during recovery.

Family, friends and coworkers can add detail. They can describe changes they have seen in your mood, habits or daily life.

What is the definition of emotional injury?

An emotional injury is psychological harm that follows an event. It can look like anxiety, depression, post-traumatic stress, or fear of a certain place or activity.

After a crash, that fear may center on driving or riding in vehicles. After a death, grief may disrupt sleep, work and daily routines. Grief is a normal response to loss. A claim looks at whether the harm is serious and documented.

Lawyers reviewing these claims usually ask three questions. How severe are the symptoms? Are they documented? Do they trace back to the event? The answers shape the claim.

Emotional injury often comes with a physical one. A traumatic brain injury or other catastrophic injury can bring both.

How does emotional distress work in car and truck accident claims?

After a serious car or truck crash, people often face physical, emotional and financial effects, and each situation is different. Fear of driving, nightmares and anxiety can follow a serious crash.

Truck crashes add another layer. Federal rules apply alongside Virginia law. The FMCSA Hours of Service of Drivers rule sets federal requirements for commercial truck driver operating hours.

Claims for emotional harm without a physical injury are narrower. Whether one fits depends on the facts. For crash-specific claims, see car accident claims and truck accident claims.

How does emotional distress work in wrongful death cases?

Families who lose a loved one may have a wrongful death claim, which must be brought by the personal representative of the deceased person. Their grief is part of the damages.

Virginia wrongful death claims follow a set process. A Virginia wrongful death action is filed by the decedent’s personal representative within two years of the death (Va. Code §§ 8.01-50(C), 8.01-244(B)), on behalf of the family members the statute protects. Family members do not file.

Virginia wrongful death damages cover the family’s sorrow, mental anguish and loss of the decedent’s companionship, guidance and care; lost income and services; medical expenses from the injury; funeral expenses; and, for willful or wanton conduct, punitive damages (Va. Code § 8.01-52).

Section 8.01-52 lets the jury or court award damages it finds fair and just, and sets out the categories of recoverable damages; who shares in an award is set out in § 8.01-53. It starts with a surviving spouse and children (Va. Code § 8.01-53). Parents and other relatives may qualify in some situations.

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

Intentional infliction of emotional distress in Virginia

A distracted driver is negligent. A person who deliberately aims to frighten or harm someone is acting in a different way. The law asks different questions about intent and conduct.

Most crash claims rest on negligence, not intent.

What damages can you recover?

Emotional harm can be part of the total damages in an injury claim. The amount varies with the facts of each case.

Other parts of a claim may include treatment for the injury, time missed from work, and the emotional harm itself.

Punitive damages are a separate category. Virginia allows punitive damages for actual malice, or for willful or wanton conduct or recklessness showing a conscious disregard for the safety of others, capped at $350,000 (Va. Code § 8.01-38.1). The jury is not told about this cap.

What should you do if you think you have an emotional distress claim?

Start with your health. Seek medical or mental health care as soon as you can, and follow the treatment plan.

Keep a written record. Note symptoms, appointments and how the harm affects daily life. Save medical records, therapy notes, and messages with family or friends about how you’re doing.

Timing matters. Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va. Code § 8.01-243(A)); the clock runs from the date of injury, not the date of discovery, with narrow exceptions.

You may wish to speak with a lawyer about your facts.

Frequently asked questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can I sue for emotional distress in Virginia without a physical injury?

It may be possible, but those claims are narrower and harder to prove.
