The short answer is that Virginia sets firm deadlines for injury claims, and some steps after a crash come much sooner. Many people searching this question are still shaken. They may be dealing with injuries, a damaged vehicle, or a loved one’s condition. Others are looking on someone else’s behalf. Asking about timing does not mean you need to hire anyone. This page gives general legal information, not advice about your own case.

Why the timing question comes up after a crash

People ask about timing because a crash can start several separate legal clocks at once.

Injuries may need ongoing care, the vehicle may sit in a repair shop, and a family may be planning a funeral. Under that stress, a simple question can feel urgent.

Each clock works differently. Some limit when a lawsuit can be filed. Others require a report or written notice much sooner. Mixing them up is an easy mistake, so it helps to separate them. This page covers filing deadlines, first steps after a crash, situations where speaking with a lawyer may be worth considering, and how to reach the firm.

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

The filing deadline and what the clock measures

The filing deadline for most injury lawsuits is the first clock to understand. Here is the rule as Virginia states it:

Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va. Code § 8.01-243(A)); the clock runs from the date of injury, not the date of discovery, with narrow exceptions.

Under Va. Code § 8.01-243, unless otherwise provided in this section or by other statute, every action for personal injuries, whatever the theory of recovery, shall be brought within two years after the cause of action accrues. A filing deadline limits when a lawsuit can be started. It is separate from the duty to report a crash to police.

Some claims carry shorter notice rules. A claim against a county, city or town for negligence requires a written statement of the claim, including the time and place of the injury, within six months, under Va. Code § 15.2-209; failure to provide it does not bar the claim if the locality’s attorney, chief executive, or mayor, or any insurer or entity providing coverage or indemnification, had actual knowledge of the claim within six months, and if the claimant was under a disability when the cause of action accrued, the tolling provisions of § 8.01-229 apply. That notice clock can run out well before two years pass.

Please do not assume a deadline applies to you, or does not, without reviewing your facts.

Steps that commonly come up right after a crash

Here is the rule as Virginia states it:

Virginia requires a driver involved in a crash with injury or death to stop and report it to police immediately (Va. Code §§ 46.2-371, 46.2-894).

Va. Code § 46.2-894 also requires the driver to give reasonable help to anyone injured. That includes taking the person to medical care when treatment appears necessary or is requested.

Medical evaluation matters after any crash, even if you feel fine at the scene. Some injuries are not obvious right away, and early records help explain what happened.

Keep your paperwork together. That means the police report number, photos, repair estimates, rental receipts, and every medical record. Insurance disputes are a separate topic. If one arises, the Virginia State Corporation Commission Bureau of Insurance explains how to file a complaint.

When may it be worth talking with a lawyer after a car accident?

A lawyer review may be worth considering when injuries are serious, a commercial truck is involved, a crash was fatal, or fault is disputed. Many people asking how soon after a car accident should you get a lawyer are facing one of those situations.

Serious or ongoing injuries, such as traumatic brain injury or spinal cord injury, can take time to understand. A lawyer can help you sort out what you need to know while you recover.

Commercial vehicle crashes add questions. Va. Code § 8.01-42.6 sets out when the finder of fact may determine that an employer is vicariously liable for an employee’s tortious conduct toward a ‘vulnerable victim,’ a term the statute defines to include, among others, a patient of a health care provider and a passenger of a common carrier (Va. Code § 8.01-42.6). Federal rules also require drug and alcohol testing after some commercial truck crashes, according to the Federal Motor Carrier Safety Administration.

See Ford Motor Co. v. Boomer.

Fault can also decide whether you recover at all. Here is the approved Virginia rule:

Virginia follows contributory negligence: if you are found even partly at fault, you may be barred from recovering, with limited exceptions (Contributory negligence bars recovery in Virginia).

Whether to speak with a lawyer is your choice. You may wish to decide once you know more about your facts.

Wrongful death and families: who files, and when?

In a Virginia wrongful death case, the filing falls to the personal representative; actions for fetal death are brought by and in the name of the natural mother, but if the natural mother dies, or is or becomes a person under a disability as defined in § 8.01-2, such action may be initiated or maintained by the administrator of the natural mother’s estate, her guardian, or her personal representative qualified to bring such action. Here is the rule as Virginia states it:

A Virginia wrongful death action is filed by the decedent’s personal representative within two years of the death (Va. Code §§ 8.01-50(C), 8.01-244(B)), on behalf of the family members the statute protects.

The personal representative is the person legally appointed to handle the deceased person’s estate. The filing deadline is in Va. Code § 8.01-244, and the filing rule is in Va. Code § 8.01-50.

Family members share in any recovery. The order in which beneficiaries receive it is set by Va. Code § 8.01-53.

A family facing this loss may wish to talk with a lawyer about who should file and when, based on their own facts.

Key points under Virginia law

You do not have to decide anything today.
