The steps often overlap, and the order can shift with the facts. This guide walks through each step in plain language.

The firm handles car accidents, truck and commercial vehicle accidents, catastrophic injuries, and wrongful death claims. The firm serves people across the Shenandoah Valley, Richmond, and Henrico County.

How a Truck Accident Claim Usually Moves in Virginia

Most truck accident claims follow the same general path, though no two crashes are alike. The path starts with the injured person’s health. It may end in court, but only if the claim does not resolve sooner.

Truck crashes often involve more parties and more records than car crashes. A commercial truck may involve a driver, an employer, a company that owns or leases the truck, and a shipping company. Each may have its own insurer and paperwork. That is why the process can look different from a typical car claim.

Start one folder for everything, on paper or on your phone. Medical records, photos, insurance letters, and crash paperwork belong in one place. Early organization makes every later step easier to follow.

If a truck crash left you or a family member hurt, you may have a claim, and the firm is glad to talk through your situation with you. A prompt evaluation creates a record that ties your injuries to the crash.

Symptoms do not always appear right away. Some get worse over time. Attend every follow-up visit, and tell each provider about every new symptom, even small ones.

Keep copies of everything. That includes discharge papers, test results, bills, prescription receipts, and therapy notes. Write down the days you missed work and the tasks you can no longer do at home.

These records show what the crash changed in your daily life. They also help anyone reviewing your claim understand the timeline of your recovery.

Step 2: Report the Crash and Get the Police Report

Reporting the crash is the first legal duty in the process. Virginia requires a driver involved in a crash with injury or death to stop and report it to police immediately (Va. Code §§ 46.2-371, 46.2-894). The driver’s duty is set out in Va. Code § 46.2-894.

The two-year period discussed later is the general deadline to file a personal injury or fraud lawsuit, unless this section or another statute provides otherwise (Va. Code § 8.01-243). It is not the deadline to report a crash.

Next, request a copy of the police crash report. A report usually lists the date, time, and place, the vehicles involved, each driver’s information, and the officer’s observations. Check it for errors. If something is wrong, ask for a correction in writing.

Keep the report number, too. Insurers often ask for it when they open a file.

Step 3: Identify Every Party Who May Be Responsible

A truck crash can involve several parties, and more than one may share responsibility. The truck driver is the most obvious. The driver’s employer, the company that owns or leases the truck, and the shipping company may also be involved. So may any other driver whose actions contributed to the crash.

Who may be responsible turns on the facts and on how each company related to the driver.

Look for clues in the paperwork. The truck’s door markings, the trailer, the bill of lading, and the police report can each name a carrier, lessor, or shipper. Photograph those markings at the scene or as soon as you can.

Step 4: Preserve Evidence Early

Evidence in a truck case can disappear quickly, so early action helps. Photos of the scene, the vehicles, and your injuries are useful. So are names and contact details of witnesses, and any dashcam or phone video.

Trucking companies keep records under federal rules. Carriers must keep supporting documents for each driver for every 24-hour period to verify on-duty not-driving time, but need not retain more than eight supporting documents per driver for each 24-hour period; if they keep eight, they must keep the documents containing the earliest and latest time indications among those eight (49 C.F.R. § 395.11). No carrier or driver may obscure, destroy, or alter those documents. Under 49 C.F.R. § 395.8, a motor carrier operating commercial motor vehicles must install and require each of its drivers to use an electronic logging device (ELD) to record the driver’s duty status in accordance with subpart B of this part no later than December 18, 2017. A motor carrier may instead require a driver operating a commercial motor vehicle to record duty status manually in a manner requiring completion of a record of duty status on not more than 8 days within any 30-day period.

If a required post-crash alcohol test is not given within eight hours following a qualifying commercial vehicle crash, such as one involving a death or one in which the driver is cited for a moving traffic violation under the conditions the rule lists, the employer must stop attempting that test (49 C.F.R. § 382.303).

Finally, keep a simple journal of pain, limits on daily activities, and time away from work.

Step 5: Deal With the Insurance Claim and the Fault Question

Insurance adjusters may contact you early, and what you say can matter later. Keep your communications organized and accurate. Write down the date, the adjuster’s name, and what was said. Avoid guessing about speed, distance, or who had the right of way.

Fault is often disputed in truck crashes, and Virginia’s fault rule can decide a claim. Virginia follows contributory negligence: if you are found even partly at fault, you may be barred from recovering, with limited exceptions (Contributory negligence bars recovery in Virginia). Talk to a lawyer about your facts.

Pursuing a claim with insurers and filing a lawsuit are different paths. Which path fits depends on the facts of the crash and the injuries.

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

Step 6: Filing a Lawsuit and the Filing Deadline

A lawsuit is filed in court, and Virginia sets a deadline for filing it. Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va. Code § 8.01-243(A)); the clock runs from the date of injury, not the date of discovery, with narrow exceptions. The statute is at Va. Code § 8.01-243.

Some claims carry notice requirements that can run out sooner than two years.

A lawsuit begins with a complaint filed in court. The defendants are then formally served. Both sides exchange records and information in a process called discovery. Some claims settle during this process, and others move toward trial.

When a Truck Crash Is Fatal: How a Wrongful Death Claim Is Filed

A wrongful death claim after a truck crash is filed by the personal representative, not by family members. A Virginia wrongful death action is filed by the decedent’s personal representative within two years of the death (Va. Code §§ 8.01-50(C), 8.01-244(B)), on behalf of the family members the statute protects. The statutes are at Va. Code § 8.01-244 and Va. Code § 8.01-50.

The damages rule is also set out by statute. Virginia wrongful death damages cover the family’s sorrow, mental anguish and loss of the decedent’s companionship, guidance and care; lost income and services; medical expenses from the injury; funeral expenses; and, for willful or wanton conduct, punitive damages (Va. Code § 8.01-52).

Family members share in any recovery rather than filing the case themselves.

How Long the Process Can Take

Timelines vary, and no single number fits every truck claim. Time depends on how serious the injuries are, how many parties are involved, how quickly records arrive, and whether the claim resolves before a lawsuit. Medical recovery often needs to be reasonably well understood before a claim can be fully assessed, which can add time.

The two-year deadline is a filing limit (Va. Code § 8.01-243). It does not mean a case takes two years to resolve.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is a police crash report the same as a lawsuit?

No. A police crash report records the crash, while a lawsuit is a filing made in court.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does every truck crash claim go to court?

No. Some claims are resolved without a lawsuit, and others are filed in court.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Should I keep my medical bills?

Yes.
