It comes from several kinds of records, and each one answers a different question. This page explains those records in plain language. For a broader overview, see the firm’s spinal cord injury page. Correll Law Firm has locations in Winchester and Harrisonburg and handles car and commercial truck crash claims for people across the Shenandoah Valley and the Richmond area.

What evidence is needed to prove a spinal cord injury claim, such as imaging, neurologist records, accident reports, and life care plans?

A spinal cord injury claim usually relies on three kinds of proof. Medical records show the diagnosis, the level of injury and its effects. Crash records show how the injury happened. Work and daily-life records show how the injury changes a person’s income and needs over time.

The strength of the proof depends on the facts of each crash and each injury. The sections below cover imaging, neurologist and treating records, crash documents, life care plans, and records of work and daily life.

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

Imaging and diagnostic records that document the injury

Imaging and hospital records are often the first proof of a spinal cord injury. They capture what doctors found close to the time of the crash.

X-rays, CT scans and MRI scans are common tests after a serious spine injury. Each one shows something different. X-rays show bone alignment and fractures. CT scans give more detailed pictures of bone. MRI scans show soft tissue, including the spinal cord, discs and ligaments.

Emergency room and admission notes matter too. They record the first exam: how the person could move, feel and breathe. Because those notes were written early, they show the injury as it was first documented.

Medical professionals read the images and write reports. Both the written report and the image files belong in the record. Keep copies of both, because a report alone may not capture everything the scan shows.

Neurologist and treating provider records that show the course of the injury

Neurologist and treating provider notes show how the injury changes over time. They often form the core of the medical proof.

Over months, these notes may record strength testing, feeling and reflex checks, bladder and bowel function, and any new problems. They also record setbacks, such as infections or pain that changes the treatment plan.

Regular follow-up visits help show the injury’s course. A gap in treatment can make it harder to show how the injury developed. When care changes, the treating doctor should write down the reasons.

Physical therapy, occupational therapy and rehabilitation facility records add more detail. They document mobility, balance, use of the hands and daily care needs. Therapists often note equipment such as walkers, wheelchairs and braces, which shows what daily life now requires.

Accident reports, police reports and witness statements

A crash report records the date, location, vehicles involved and what the officer observed at the scene. It is often the first official account of how the crash happened.

Virginia requires a driver involved in a crash with injury or death to stop and report it to police immediately (Va. Code §§ 46.2-371, 46.2-894).

Witness statements, photographs of the scene and vehicles, and any dashcam or vehicle data can help show how the crash happened. Witness memories fade, so names and ways to reach each witness should be written down early. Photos taken soon after the crash show positions, damage and road conditions.

For commercial truck crashes, the records go further. Federal rules require motor carriers to keep certain records, and the required periods differ. Driver records of duty status must be kept for at least six months from the date of receipt (49 C.F.R. § 395.8). Motor carriers must keep an accident register for three years after each accident (49 C.F.R. § 390.15). Because some periods are short, early requests for records matter.

Life care plans and future medical and care needs

A life care plan is a written projection of the care a person may need in the future. It is usually prepared by a life care planner working with medical professionals.

The plan builds on treatment records and the level of injury. It may list future medical visits, medications, equipment, home changes and attendant care. It estimates how those needs may change over time.

A life care plan is a projection, not a certainty. Needs can shift as a person recovers or as the condition changes. Good plans explain the reasons behind each item, so a reader can follow the logic.

Past medical bills are kept separate from the plan. Bills show care already received. The plan shows care that may be needed later. Keeping them apart makes each one easier to read.

How the level and severity of the injury are documented

Medical professionals classify a spinal cord injury by its level and by whether it is complete or incomplete. That classification comes from examination and imaging.

The spinal nerves control different parts of the body. Cervical nerves (C1 to C7) reach the back of the head, the neck and shoulders, the arms and hands, and the diaphragm. Thoracic nerves (T1 to T12) reach the chest muscles and many organ systems. Lumbar and sacral nerves reach the lower abdomen, back, parts of the legs and feet, and the area around the anus (NINDS).

An injury between C1 and C4 can stop breathing, because those nerves drive the diaphragm (NINDS). This is why early records of breathing matter.

A complete injury generally means no movement or feeling below the injury. An incomplete injury means some function remains. Records of strength, feeling and movement show which body areas are affected and how that changes over time.

Work effects are documented through employment records, paystubs, tax records and employer statements about the duties a person can and cannot perform. In any suit brought for personal injury or death, Virginia law says provable loss of income is not reduced because of reimbursement from another source, and that reimbursement is not admitted into evidence (Va. Code § 8.01-35).

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

Fault and deadline questions that affect which evidence matters

Fault and timing decide which evidence matters most. Crash records and witness accounts bear directly on who was at fault and how the crash happened.

Virginia follows contributory negligence: if you are found even partly at fault, you may be barred from recovering, with limited exceptions (Contributory negligence bars recovery in Virginia). Talk to a lawyer about your facts.

That is why medical and crash records should work together to link the injury to the crash.

Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va. Code § 8.01-243(A)); the clock runs from the date of injury, not the date of discovery, with narrow exceptions.

Keeping and organizing evidence over time

Keeping complete, dated records is the most practical way to protect proof. Organization matters as much as collection.

Keep every medical record, scan report, therapy note and bill in one place. Save the crash report and any citation. Keep photos, video, and witness names with notes on what each witness saw.

Write a daily log of limitations. Record which tasks got harder, how sleep and mood changed, and what help a family member gave. Note each change in care and the date it happened.

Pre-crash records matter too. Past work history, pay records and earlier medical notes can show a person’s condition and job before the injury. They help separate what changed from what was already there.

This page covered imaging and diagnostic records, neurologist and therapy notes, crash and witness documents, commercial truck records, life care plans, injury level documentation, and work records. Together they show how the crash happened and how the injury affects daily life. A spinal cord injury claim often relies on all of them.

Don’t wait to find out where you stand.
