The duty is immediate, not a later date.

The question “What is the maximum time to report an accident?” mixes up three separate clocks. The first is the police report. The second is notice to your insurance company. The third is the deadline to file a lawsuit. Each one follows its own rules.

Many people hear “two years” and assume it is the reporting deadline. It is not. The two-year period covers filing a lawsuit, and it is explained later on this page.

No single number answers every situation. A crash can trigger a police duty at the scene, a notice clock under your insurance policy, and a lawsuit window that runs much later. Knowing which clock applies to which step helps you avoid missing one.

If you were hurt in a crash, you may have a claim, and the firm is glad to talk through your situation with you. Code § 46.2-894.

The stop-as-close-as-possible rule is in § 46.2-894. The driver must give a name, address, driver’s license number and vehicle registration number to State Police or local law-enforcement agency, to the person struck and injured if that person appears able to understand and retain the information, or to the driver or some other occupant of the vehicle collided with, or the custodian of the damaged property. The driver must also render reasonable assistance to any person injured in the accident, including taking the injured person to a physician, surgeon, or hospital when it is apparent that medical treatment is necessary or the injured person requests it.

If injuries keep you from doing this, the law sets a different order. You must make the report as soon as reasonably possible. A reasonable effort to locate the other people involved applies only where injuries prevent the driver from complying, under § 46.2-894.

The first hour usually comes down to a few steps. Check everyone for injuries. Call 911. Stay at the scene until help arrives. Write down names, insurance details and license plate numbers.

Any person convicted of a violation of the duty to stop and report is guilty of a Class 5 felony or a Class 1 misdemeanor, depending on the injury, death, or property damage (Va. Code § 46.2-894). A willful failure to report is a Class 4 misdemeanor under § 46.2-371. Under Va. Code § 46.2-371, it is a Class 4 misdemeanor. A conviction under Va. Code § 46.2-894 can be a Class 5 felony when the crash causes injury or death or results in more than $1000 of property damage.

Reporting to your insurance company and late-claim questions

Your insurance policy sets its own notice rules. The exact timing is in the policy wording, so read the reporting clause that applies to you. Those rules can run out sooner than the lawsuit period.

Is it worth reporting? Prompt notice helps keep the crash record current and lets the insurer start its review. Reporting does not decide how a claim ends.

Is it ever too late? A late notice can affect a claim. Whether it does depends on the facts and on the policy language.

The Virginia Department of Motor Vehicles keeps records of reportable crashes. Its crash and injury reporting guidance explains the duties for crashes. Its police crash report page explains who may obtain a report.

The two-year limit to file a personal injury lawsuit

Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va. Code § 8.01-243(A)); the clock runs from the date of injury, not the date of discovery, with narrow exceptions. The main rule is in Va. Code § 8.01-243. The accrual rule is in Va. Code § 8.01-230.

This is a deadline for filing a lawsuit. It does not set a deadline for reporting a crash to police. It does not replace the insurance notice rules in your policy. Each duty runs on its own schedule.

Some claims carry notice requirements that run out sooner than the lawsuit period. Do not treat the two-year date as the only date that matters.

Dates are easy to lose track of after a crash. Write down the crash date, the time, and the date you first received treatment. Those dates anchor the timeline.

Wrongful death: who files and the two-year period

A Virginia wrongful death action is filed by the decedent’s personal representative within two years of the death (Va. Code §§ 8.01-50(C), 8.01-244(B)), on behalf of the family members the statute protects. The action is brought under Va. Code § 8.01-50, and its time limit is in Va. Code § 8.01-244.

Families often mix up who files and who shares. Family members generally do not file the case themselves; the personal representative brings the action, except that a fetal death action is brought by and in the name of the natural mother, or, if she dies or is under a disability, by the administrator of her estate, her guardian, or her personal representative (Va. Code § 8.01-50). The distribution rules are in Va. Code § 8.01-53. That statute names the surviving spouse and children first, and it names other relatives only when the statute’s conditions are met.

The wrongful death clock runs from the date of death. The police reporting duty still applies at the scene, on the day of the crash, if the driver was involved in it.

How the deadlines fit together after a crash

After a crash with injury, three clocks can run at the same time. Police reporting happens at the scene. Insurance notice follows your policy. The lawsuit window runs for two years.

At the scene: report to police immediately when injury or death is involved.

With your insurer: give notice under the terms of your policy.

For a lawsuit: in a wrongful death case, within two years after the death of the injured person (Va. Code § 8.01-244). For other personal injury claims, generally within two years after the cause of action accrues (Va. Code § 8.01-243).

Truck and commercial vehicle crashes can involve more records and more parties, including the vehicle owner and other drivers. Early attention to what was recorded at the scene can matter, because details fade over time.

Keep the three clocks separate. A missed police report, a late insurance notice and a missed lawsuit deadline are different problems, and each can have its own consequences.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is there a set number of hours to report a crash to police in Virginia?

No. Virginia’s rule is immediate when the crash involves injury or death.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is the two-year period the time to report a crash?

No. The two-year period is the deadline to file a lawsuit, not to report a crash (Va.
