What Family Members Share in the Recovery<\/h2>\n

Family members do not file the wrongful death action. They share in whatever is recovered.<\/p>\n

Va. Code \u00a7 8.01-54<\/a> reads: “The remainder of the amount recovered shall thereafter be distributed by the personal representative, as specified in subsections A and B above, to the beneficiaries set forth in \u00a7 8.01-53<\/a>; provided that any distribution made to any such beneficiaries shall be free from all debts and liabilities of the decedent.” The statute lists beneficiaries in a set order. If there is no surviving spouse, child, or grandchild, it reaches parents, brothers, sisters and certain relatives primarily dependent on the decedent who share the household (Va. Code \u00a7 8.01-53<\/a>).<\/p>\n

Virginia treats the injured person’s own claim differently. Under Va. Code \u00a7 8.01-25<\/a>, a claim for injury generally continues after the injured person’s death rather than ending with it.<\/p>\n

Virginia sets out wrongful death damages by statute. Virginia wrongful death damages cover the family’s sorrow, mental anguish and loss of the decedent’s companionship, guidance and care; lost income and services; medical expenses from the injury; funeral expenses; and, for willful or wanton conduct, punitive damages (Va. Code \u00a7 8.01-52<\/a>).<\/p>\n

The statute lets the jury or court award damages that seem fair and just. So the list describes damages the law allows, but the statute says the award may not be limited to them, and it does not say what any family will receive.
