The value comes from your injuries, your losses, the vehicle damage, and how well each loss is documented.

Knowing how to value a car accident case starts with the parts of the claim. People in Winchester, Harrisonburg, the northern Shenandoah Valley, Richmond and Henrico County face the same Virginia rules. The firm handles car and truck crash claims for people from the Shenandoah Valley to Richmond and Henrico County.

Why a Car Accident Case Has No Single Built-In Value

Most people want to know what their case is worth early on. The honest answer is that no standard number exists. The value depends on the crash and on the injuries that follow.

Two crashes can look alike and still differ a great deal. One driver may need a few weeks of therapy and then return to work. Another may need surgery, months away from the job, and care that lasts for years.

This page explains the parts of a claim. It does not give a number, a range, or a prediction. Think of it as a guide to what to gather and why each piece matters.

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

The Two Main Categories of Damages

Damages are the money a person may seek for losses caused by a crash. Most claims sort those losses into two groups: economic damages and non-economic damages.

Economic damages are losses with a paper trail behind them. Medical bills, lost income, and vehicle repair bills are examples. Receipts, invoices, and records usually prove them.

Non-economic damages are harms that do not come with a receipt. They include physical pain, trouble sleeping, limits on daily activities, and loss of enjoyment of life. They are shown through medical notes, a personal journal, and the words of the injured person and the people who know them.

A claim usually values both groups together. The balance differs from case to case. A person with a short recovery may have mostly economic losses. A person with lasting injuries may have a larger share of non-economic harm.

Medical Expenses and Treatment Records

Medical expenses are the health care bills tied to the crash. They often include emergency care, X-rays and MRIs, surgery, physical therapy, prescriptions, and future care a doctor recommends.

Treatment records matter as much as the bills. Seeing a doctor soon after a crash creates an early record of symptoms. Later, the records show whether the injured person followed the treatment plan.

A missed follow-up or a long gap in care can raise questions that are hard to answer later. Tell every provider about every symptom, even minor ones.

Keep every itemized bill, visit summary, and doctor’s note. Ask providers for copies as you go, not years later.

Serious injuries create long records. A spinal cord injury or a traumatic brain injury may require years of follow-up. Those notes help describe future medical needs.

Lost Income and Reduced Ability to Work

Lost income is the earnings a person missed because of the injury. Under Va. Code § 8.01-35, provable damages for lost income are not reduced because another source reimbursed that income.

The same statute bars admitting that reimbursement into evidence. Your own records still matter, so keep them organized.

Useful documents include earnings statements, tax returns, employer letters showing time missed, and records of any sick or vacation time used.

Reduced earning capacity is a separate issue. If an injury limits the type or amount of work a person can do going forward, the loss may extend beyond the time off. Doctors’ notes about work restrictions are often central to that claim.

Self-employed people document income differently. Client invoices, business bank records, and tax filings show what the work produced. A simple log of lost jobs and canceled projects also helps.

Vehicle Damage, Repair Estimates and Diminished Value

Vehicle damage is usually shown by repair estimates, photos, and the repair shop’s findings. If the vehicle is a total loss, its value is based on what it was worth just before the crash.

Sale listings, comparable vehicles, and maintenance records help support that pre-crash market value. Keep the title, service history, and receipts for upgrades.

Rental vehicles are a separate item. Under Va. Code § 8.01-66, a person entitled to recover for damage to or destruction of a motor vehicle may recover the reasonable cost which was actually incurred in hiring a comparable substitute vehicle. The rental period cannot exceed a reasonable time for repairs, or, for a total loss, a reasonable time to buy a new vehicle.

The statute also says the claimant still has a duty to mitigate damages. In plain terms, a rental should not run longer than needed. Keep rental agreements and the dates the vehicle was out of service.

Diminished value is the drop in a vehicle’s market value after a repaired crash. Whether it can be recovered depends on the facts.

How Fault, Insurance Coverage and Policy Limits Affect the Claim

Fault decides whether a claim can succeed. Insurance decides where the money can come from. One fault rule matters here:

Virginia follows contributory negligence: if you are found even partly at fault, you may be barred from recovering, with limited exceptions. Talk to a lawyer about your facts.

Under Va. Code § 46.2-472, owner’s policies effective on or after January 1, 2025 must carry at least $50,000 for bodily injury or death to one person in one accident. The same statute sets $100,000 for two or more persons and $25,000 for property damage to others. Those are minimums, and a policy may carry higher limits.

Policy limits cap what can be collected from that policy. A claim can be worth more than the at-fault driver’s limits.

If those limits fall short, underinsured motorist coverage may matter. Under Va. Code § 38.2-2206, an injured person may settle with the liability insurer for its available limits. That settlement is made without prejudice to any underinsured motorist benefits or claim.

The Insurance Institute for Highway Safety notes that property damage liability covers damage an at-fault driver causes to other people’s vehicles or property. The police report, photos, witness statements, and vehicle data shape how fault is presented.

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

Pain, Daily Life and How Non-Economic Harm Is Shown

Non-economic harm is shown through records, consistency, and the injured person’s own account. No formula turns it into a dollar amount. The weight it receives depends on the records and the person’s situation.

Useful records include treatment notes describing symptoms, a pain or activity journal, and statements from family and friends. The injured person’s own testimony also counts.

A journal works best when entries are dated and written close to the events. A note such as “could not lift the laundry basket” is easier to check against medical records than a memory written months later.

Consistency matters too. When early visits describe symptoms that later reports also describe, the account is easier to follow.

Write down daily life changes with specifics. Include sleep, chores, hobbies, time with children or grandchildren, and any limits on driving.

Timing, Crash Reporting and Filing Deadlines

Start with the reporting duty. Virginia requires a driver involved in a crash with injury or death to stop and report it to police immediately (Va. Code §§ 46.2-371, 46.2-894).

For the lawsuit deadline, Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va. Code § 8.01-243(A)); the clock runs from the date of injury, not the date of discovery, with narrow exceptions.

Some claims carry notice requirements that run out sooner.

Early evidence is easier to keep organized while it is recent. Photos taken at the scene, the police report, and early medical records give a clear starting point.

Together, these parts build the value of a car accident case. No single piece decides it alone.

Common questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What should I keep after a crash?

Keep itemized bills, treatment notes, repair estimates, rental receipts, and a dated journal of symptoms.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can a calculator give an exact value?

No. A calculator cannot weigh the facts of your crash, your injuries, and your records.
</details>

Don’t wait to find out where you stand.
