A lawsuit keeps the claim open, but it adds time, uncertainty and personal strain. So, what are the risks of pursuing a TBI case versus settling? Each path carries real risks, and this article explains them in plain words. It does not predict how any case will end.

Why the Choice Between Settling and Suing Matters After a Brain Injury

The choice matters because a settlement usually ends the claim, while a lawsuit keeps it open for longer. A traumatic brain injury is hard to read in the first weeks after a crash. Headaches, memory trouble, trouble focusing and mood changes can appear or grow over weeks or months. Symptoms that seem minor at first can later affect work, driving and family life. So the decision often arrives before the full picture is clear.

A settlement is a negotiated agreement. The injured person’s side and the insurer agree on terms that end the claim. A lawsuit is a case filed in court. It may end in a settlement before trial, or it may go to a judge or jury. Both paths are real options, and both carry risks worth understanding first.

If you are weighing these choices after a brain injury, you do not have to face them alone, and the firm is ready to talk through the facts of your situation. Both sides exchange medical records and information about the crash. The insurer makes an offer, and the parties keep talking until they agree or stop.

The biggest risk is finality. Once a settlement is signed, the claim generally ends. If new symptoms, surgery or cognitive decline appear later, the same claim may not cover them.

Multiple parties add another layer. Under Va. Code § 8.01-35.1, when a release or covenant not to sue is given in good faith to one of several persons liable for the same injury, it does not discharge the others unless its terms so provide. In a truck crash, the driver, the carrier or others may share responsibility. A deal with one party can change what happens with the rest.

Timing is a risk too. Settling before the medical picture is stable means deciding on incomplete facts about future care and work ability. Pressure to decide quickly can add to that strain. An offer may also reflect the insurer’s view of the case rather than the full effect of the injury on daily life.

How a Lawsuit and Trial Work and Their Risks

A lawsuit is the formal case filed in court. Litigation is the wider process of resolving a dispute through the courts. A case starts with a filing that names the parties and describes the injury. Next comes discovery, when each side requests records and information from the other.

Depositions follow. A deposition is sworn testimony given out of court and recorded. If the case does not settle, it may go to a trial before a judge or jury. Each stage adds time, and each stage asks the injured person to share details about their health and daily life.

The first risk is time. A lawsuit can run for a long period, and waiting brings personal and financial strain for the injured person and family. The second risk is uncertainty. A jury may decide differently than either side expects, and a verdict can land higher or lower than an offer on the table.

The third risk is personal demand. Depositions and testimony about daily limits can be hard for someone recovering from a brain injury. Memory and focus problems can make long questioning harder to get through.

Each case turns on its own evidence, witnesses and medical proof. The outcome of any trial cannot be predicted from the injury alone.

Why Timing Is Harder to Judge in a TBI Case

A TBI case often needs a clear medical picture before anyone can judge future losses. That picture can take months to form. Doctors may track symptoms over time, and some patients need several kinds of testing before long-term needs are clear.

Neurological exams, brain imaging and neuropsychological testing are common examples. Neuropsychological testing looks at thinking, memory, attention and mood. Results can change as recovery goes on, which is why the medical course matters so much. A written symptom journal and copies of medical records can help keep that course organized.

Timing cuts both ways. A settlement reached early may come before recovery is clear. A lawsuit may move slowly while the medical picture develops, and that wait adds strain. Neither path removes the timing question. The injured person still has to decide when the picture is clear enough to act.

How long a TBI case takes follows the medical course and the details of the claim. Two cases with similar injuries can move at very different speeds.

The Filing Deadline and Why Waiting Carries Risk

Waiting while talks continue is one of the easiest risks to overlook. Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va. Code § 8.01-243(A)); the clock runs from the date of injury, not the date of discovery, with narrow exceptions.

Some claims carry notice requirements that run out sooner than the filing deadline.

A claim that is still under discussion can move toward its deadline with no lawsuit on file. Keep track of key dates from the start. Do not assume that talks will pause the clock.

How Partial Fault Can Change the Risk Picture

Fault is one of the biggest questions in any crash claim. Many injured people worry that their own actions added to the crash. That question affects both paths, because it can shape the offer and what a jury might decide.

Virginia follows contributory negligence: if you are found even partly at fault, you may be barred from recovering, with limited exceptions. Talk to a lawyer about your facts.

Fault can also be shared among several parties.

A lawsuit forces both sides to test fault through discovery and at trial. That process can be stressful. It can also bring out facts the injured person did not know about, which is a source of information as well as a risk.

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

Civil and Criminal Matters After the Same Crash

A crash can lead to a civil claim for injuries and, separately, a criminal case brought by the state; under Va. Code § 8.01-229(K), the time such a criminal prosecution is pending is not computed as part of the period within which the civil action may be brought. The two run on separate tracks.

Virginia requires a driver involved in a crash with injury or death to stop and report it to police immediately (Va. Code §§ 46.2-371, 46.2-894). The two-year period is the deadline to file a lawsuit, not to report a crash (Va. Code § 8.01-243).

The driver must immediately give notice of the accident to a law-enforcement officer (Va. Code § 46.2-371); this section does not address whether time during a criminal prosecution counts toward the civil filing period. In a personal injury or wrongful death case, if a criminal prosecution arising out of the same facts is started, the time the prosecution is pending does not count toward the civil filing period, and the civil action may then be brought within the remaining period or within one year, whichever is longer (Va. Code § 8.01-229(K)).

Statements made in one process may matter in the other. Families often feel both tracks at once, which adds stress.

When Punitive Damages Enter the Discussion

Punitive damages are a separate question from compensation for injuries, and they come up only in some cases.

The injured person cannot assume it applies in every case. Whether it applies depends on the crash and the evidence.

Virginia allows punitive damages for actual malice, or for willful or wanton conduct or recklessness showing a conscious disregard for the safety of others, capped at $350,000 (Va. Code § 8.01-38.1).

Pursuing punitive damages can lengthen a case and add contested issues. That matters when weighing settlement against trial.

Weighing the Risks of Each Path

Settlement carries the risk of finality and incomplete information. A lawsuit and trial carry the risks of time, uncertainty and personal strain. Each side of that trade-off is real, and neither removes the timing question. Weighing what does pursuing a TBI case versus settling mean for your family starts with those trade-offs.

A few questions can help organize your thinking. Have symptoms leveled off, or are they still changing? Is future care documented by the treating providers? How is the family coping day to day? How much certainty does the injured person need, and how much waiting can the household handle?

The right choice depends on the facts of the crash and the injury.

Common Questions
<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
How long do TBI cases take to settle?

The timeline follows the medical course and the details of the claim, so no single answer fits every case.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Is litigation the same thing as a lawsuit?

Not quite.
