That driver may be found later, or may never be identified.

Virginia requires a driver involved in a crash with injury or death to stop and report it to police immediately (Va. Code §§ 46.2-371, 46.2-894). The statutes are at Va. Code § 46.2-894 and Va. Code § 46.2-371.

Under Va. Code § 46.2-894, a driver involved in an accident that kills or injures someone, or damages an attended vehicle or other attended property, is required to stop at or near the scene, without obstructing traffic, and to report. If injuries sustained in the accident prevent the driver from complying, the driver must, as soon as reasonably possible, make the required report to the State Police or local law-enforcement agency and make a reasonable effort to locate the person struck, the other driver or an occupant of the vehicle hit, or the custodian of the damaged property, and give that person the driver’s name, address, license number and registration number (Va. Code § 46.2-894). The driver must give a name, address, license number and registration number. The driver must also help an injured person, including taking them to a doctor or hospital when treatment is apparent or requested. A person convicted under this section is guilty of a Class 5 felony if the accident results in injury to or the death of any person, or if it results in more than $1000 of damage to property. If the accident results in damage of $1000 or less to property, the offense is a Class 1 misdemeanor (Va. Code § 46.2-894).

A prompt police report creates a record of the time, place and events while they are fresh. For an overview of crash claims, see car and truck crash claims.

Immediate Steps at the Scene

Safety comes first, then medical care, then a record of what you saw. Move out of traffic if you can, and turn on your hazard lights. Call 911 if anyone is hurt or if the other vehicle has already left.

Get medical care as soon as you can, even when symptoms seem minor. Tell the provider how the crash happened. Keep notes on pain, dizziness, headaches or trouble sleeping in the days that follow.

Photograph the vehicles, your position on the road, skid marks, debris, traffic signals and lighting. Take wide shots and close-ups. Include anything that shows which direction each vehicle was traveling.

Write down what you know about the other vehicle while you still remember it. Note the make, model, color, body damage, any part of a plate and the direction it went.

Ask witnesses for their names and phone numbers. Note nearby businesses or homes that may have security cameras. Security video is often recorded over, so write those locations down before you leave.

Reporting the Crash and Creating an Official Record

A police report creates an official record of the time, place, injuries and any details about the other vehicle. Ask the officer for the report or incident number. Write it down with the name of the agency that responded.

Give a clear, factual account. Describe what you saw and heard. Do not guess at speed or fault. If you later find an error, put the correction in writing and send it to the agency.

A report is one piece of evidence. It does not decide who was at fault on its own. Other proof, such as photos, witness accounts and records, still matters.

Start a dated file now. Include medical bills, pharmacy receipts, repair estimates, records of missed work and the report number. A date on each item makes the timeline easier to follow later.

How a Missing Driver Changes the Claim

When the other driver cannot be found, a claim usually depends on other proof and on any insurance that applies. Virginia’s uninsured motorist law is at Va. Code § 38.2-2206.

Which coverage applies depends on the facts and the policy language. Insurers will ask for the same records and statements, so keep copies of everything you send and receive.

Searches for the other vehicle often rely on video, paint transfer, debris and witness accounts. Those leads can disappear quickly. That is why early notes and photos matter.

Evidence That Fades Over Time

Evidence from a hit-and-run can be lost quickly, so the first weeks matter most. Security video can be recorded over. Damaged vehicles get repaired. Road surfaces change after resurfacing. Witness memories blur with time.

Medical records tie the injury to the crash. A gap in treatment can be questioned by the other side. Follow the care plan your provider gives you, and keep your appointment records.

Build a simple evidence folder. Date each item: photos, receipts, the report number, and a daily note on symptoms and on what you could not do that day, such as work or driving.

Ask in writing that video, vehicle data and records be kept. Requests made early have the best chance of being honored. Footage that is already gone cannot be recovered.

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

The Two-Year Deadline to File a Lawsuit

Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va.
