Virginia puts clear duties on any driver involved in a crash with injury or death. The steps taken in the first hours and days can also shape what evidence is available later. This guide explains those duties, the first steps to take, and the time limits that may apply.

What Virginia Law Requires of a Driver After a Crash

A driver in a crash with injury or death has a legal duty to stop, and that duty stands apart from who caused the crash. Virginia requires a driver involved in a crash with injury or death to stop and report it to police immediately (Va. Code §§ 46.2-371, 46.2-894).

Under § 46.2-894, the driver of a vehicle involved in an accident that kills or injures a person, or damages an attended vehicle or other attended property, must immediately stop as close to the scene as possible without obstructing traffic. The driver must also report name, address, driver’s license number, and vehicle registration number to the State Police or local law-enforcement agency, to the person struck if that person appears capable of understanding and retaining the information, or to the driver or other occupant of the vehicle collided with or the custodian of other damaged property, and must give reasonable assistance to anyone injured, including taking them to a physician, surgeon, or hospital if medical treatment appears necessary or is requested. A violation that results in injury or death is a Class 5 felony under that statute. A willful failure to give notice of an accident resulting in injury to or death of any person to a law-enforcement officer under § 46.2-371 is a Class 4 misdemeanor.

Leaving the scene is a legal issue on its own. It can also matter later in a civil claim. The two-year period discussed below is the deadline to file a lawsuit, not a deadline to report a crash (Va. Code § 8.01-243).

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

Immediate Steps If You or a Loved One Was Hurt

The first steps are to get to safety, call 911, and ask for a medical evaluation, even when injuries seem minor. Some serious injuries, including brain and spinal cord injuries, may not be obvious at the scene. A medical evaluation also creates a record that links your care to the crash.

When police arrive, describe what you saw. Give the direction of travel and the color and make of the cab. Mention any company name or number on the trailer, and any part of a license plate you noticed. Note whether the truck slowed, kept going, or changed lanes. If you can’t speak because of your injuries, a passenger or witness can give these details for you.

Keep records of every visit, including dates, providers, and what you were told. Attend follow-up visits. A gap in care can make it harder to tie later symptoms to the crash.

Evidence and Details to Gather Quickly

Evidence is easiest to collect in the first hours and days, before the scene is cleared and the vehicles are repaired. Start with these items.

Photograph the scene, vehicle damage, skid marks, and debris. Include any markings on the truck or trailer. If you can’t take photos yourself, ask a passenger, a witness, or a family member to do it.

Get names and contact details for witnesses while they are still nearby. Note nearby businesses that may have cameras. On busy routes such as Interstate 81 through the Shenandoah Valley, that step can matter.

Ask police to request traffic or business camera footage. Write down the officer’s name and report number.

Write a timeline while memory is fresh. Include the time, weather, lighting, road conditions, and route.

Keep every medical record, receipt, and record of missed work. Save every letter or message from an insurer. Don’t post details about the crash online while the claim is open.

Store originals safely and keep copies of everything.

Reporting the Crash to Police and Your Insurer

A police report creates an official record of the crash, the injuries, and the truck’s departure. Ask for the report number and the officer’s name. Ask for a copy once it is available, and check that the truck details match what you told the officer.

Virginia requires auto liability policies to include uninsured motorist coverage at no less than the minimum limits in § 46.2-472, and a named insured may reject only the additional uninsured motorist coverage above those minimums by notifying the insurer (Va. Code § 38.2-2206). You may wish to ask your insurer how that coverage applies when the truck cannot be identified or located.

When you speak with adjusters, stick to facts you know. This matters most while your injuries are still being evaluated. Keep a written log of every call, including the adjuster’s name and the date.

Who May Be Responsible When a Commercial Truck Is Involved

The driver may be responsible, and others may be too, depending on the facts of the crash. Federal rules place duties on the motor carrier that operates the truck. The rule says that when a duty is prescribed for a driver, it is the carrier’s duty to require observance of that duty (49 C.F.R. § 390.11). Who employed the driver and who controlled the truck can matter.

Virginia follows contributory negligence: if you are found even partly at fault, you may be barred from recovering, with limited exceptions. Talk to a lawyer about your facts.

Finding the driver and the company can take time. It may depend on police work, company records, and the formal exchange of information in a lawsuit, called discovery.

Damages, Punitive Damages, and Wrongful Death Claims

Injuries affect people in different ways, including their health, their work and their daily routines.

Virginia allows punitive damages for actual malice, or for willful or wanton conduct or recklessness showing a conscious disregard for the safety of others, capped at $350,000 (Va. Code § 8.01-38.1).

Under Va. Code § 46.2-894, a driver who violates this section in an accident that results in injury to or the death of any person is guilty of a Class 5 felony; Virginia law also allows punitive damages in an action for personal injury or death arising from conduct that constitutes a felony violation of § 46.2-894 (Va. Code § 8.01-44.5:1). Under Va. Code § 46.2-894, any person convicted of a violation of this section is guilty of a Class 5 felony if the accident results in injury to or the death of any person; punitive damages are addressed separately in Va. Code § 8.01-44.5:1. The jury must find that the conduct met the Virginia standard.

If a crash causes a death, the family’s claim follows its own rules. A Virginia wrongful death action is filed by the decedent’s personal representative within two years of the death (Va. Code §§ 8.01-50(C), 8.01-244(B)), on behalf of the family members the statute protects.

Virginia wrongful death damages cover the family’s sorrow, mental anguish and loss of the decedent’s companionship, guidance and care; lost income and services; medical expenses from the injury; funeral expenses; and, for willful or wanton conduct, punitive damages (Va. Code § 8.01-52).

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

Time Limits and Why Early Action Matters

Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va. Code § 8.01-243(A)); the clock runs from the date of injury, not the date of discovery, with narrow exceptions.

Some claims carry notice requirements that run out sooner than the lawsuit deadline. Identify the earliest dates in your case promptly. Keep a calendar with the crash date and every date that follows.

Evidence can also fade. Video can be recorded over, and memories and vehicle records can change over time. That is one reason the early steps in this guide matter. The timeline can differ from case to case.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
What should I do if a commercial truck driver left the scene in Virginia?

Get medical care, record what you saw, and gather evidence as soon as it is safe.
