It shows when the driver was driving, on duty but not driving, resting in the sleeper berth, or off duty. After a Virginia truck crash, that record can become a key part of the story. This guide explains the truck driver logbook after crash Virginia investigations often rely on, what electronic devices add, and which records can disappear if no one asks for them in time. The firm, with offices in Winchester and Harrisonburg, represents people hurt in car and commercial truck crashes from the Shenandoah Valley to Richmond and Henrico County.

What a Truck Driver’s Logbook Records

A driver’s logbook, also called the record of duty status, tracks the driver’s time in four categories. Those are driving, on duty not driving, sleeper berth, and off duty. Federal rules require a motor carrier, except for a private motor carrier of passengers (nonbusiness), to make each driver record that status for every 24-hour period (49 C.F.R. § 395.8). Each change in status must also show the city, town or village and State abbreviation where it happened; if the change occurs at a location other than a city, town, or village, show one of the options the rule lists, such as the highway number and nearest milepost followed by the nearest city, town, or village and State abbreviation.

The log ties directly to hours-of-service limits. A driver may not drive without first taking 10 consecutive hours off duty. A driver may not drive after 14 consecutive hours from coming on duty, and may drive only 11 hours in that window. Drivers must keep the log accurately.

For an overview of this practice area, see the firm’s commercial vehicle accidents page.

If a commercial truck crash hurt you or someone you love, you may have a claim, and the firm is ready to talk through your situation. An electronic logging device, or ELD, records much of the same information on its own. Under federal rules, motor carriers must require electronic logging device (ELD) use, and paper logs are allowed only in the limited circumstances the rules list (49 C.F.R. § 395.8(a)(1)(i)).

An ELD automatically records the date, time, truck location, engine hours and vehicle miles. It also records driver, vehicle and carrier identification. When a truck is moving and no status change has occurred for an hour, the device adds an intermediate entry (49 C.F.R. § 395.26).

The log is only one piece of the record. Other records can exist alongside it. These include dispatch messages, GPS and telematics data, fuel and toll receipts, and bills of lading. Each one records its own times or places. When they line up, the trip timeline is easier to follow. When they do not, the gap can prompt questions about the driver’s schedule.

Why Logs Matter After a Crash

Logs matter because they show what the driver was doing in the hours before a crash. Investigators look at how long the driver had been working and whether the driver had rested.

Federal rules bar a driver from operating a commercial vehicle, and a motor carrier from requiring or permitting a driver to operate one, when fatigue, illness or another cause has impaired the driver’s ability or alertness enough to make driving unsafe, except in a case of grave emergency where compliance would increase the hazard (49 C.F.R. § 392.3). A log can show whether enough off-duty time came before the trip, or whether a required break was taken.

Investigators read the log alongside the police report, vehicle data, witness statements and medical records. Accident reconstruction professionals may review these records to test a timeline. Their conclusions depend on what data exists.

Common Logbook Violations and Falsified Records

Logbook problems often involve three things. Those are driving past hour limits, missing required breaks, and recording off-duty time while the truck was moving.

A falsified or inaccurate log is sometimes called a dead log. It is a log whose timeline does not match the truck’s data or other records. Federal rules bar a motor carrier, its agents, officers and employees from making a fraudulent or intentionally false entry on a required record (49 C.F.R. § 390.35).

A gap between a paper log, an ELD file, fuel receipts and GPS data can lead investigators to ask more questions. The gap alone does not prove a violation. Whether a violation happened is a question investigators and courts resolve from all the evidence. A log alone does not answer it.

Reporting the Crash and What to Note at the Scene

Virginia requires a driver involved in a crash with injury or death to stop and report it to police immediately (Va. Code §§ 46.2-371, 46.2-894). The driver must also give name, address, license and registration numbers, and give reasonable help to anyone hurt (Va. Code § 46.2-894).

It is not the deadline to report a crash.

If you are able, note the truck’s company name and any DOT number on the cab or door. Write down trailer markings, the time and the location. Note nearby cameras and the names of witnesses. These details help match the truck to later records. A police report may record statements and any citations issued at the scene.

Preserving Logs and Electronic Records in Time

Records are kept for a limited time, so the timing of a written request matters.

Companies must keep records for minimum retention periods. After those periods, records may be destroyed at the discretion of company management, but this does not excuse compliance with the lawful requirements of any other governmental body prescribing longer retention periods (49 C.F.R. § 379.3). Waiting too long can mean the records are gone.

A preservation request is a written demand that the company keep logs, ELD data, dispatch communications and maintenance records. Keep a copy of what you send and the date you sent it.

Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va. Code § 8.01-243(A)); the clock runs from the date of injury, not the date of discovery, with narrow exceptions.

Some claims carry notice requirements that run out sooner. Under Va. Code § 15.2-209, a negligence claim against a county, city, or town is forever barred unless a written statement of the nature of the claim, including the time and place of the injury, is filed within six months after the cause of action accrued. A missing statement does not bar the claim if the locality’s attorney, chief executive or mayor, or an insurer or entity providing coverage or indemnification of the claim, had actual knowledge of the claim within that same six-month period.

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

How Records Fit Into a Virginia Truck Crash Claim

Logs, electronic data and the crash report work together to build a timeline of the driver’s hours and movements. For a Virginia truck crash, the truck driver logbook after crash often becomes one piece of that larger timeline.

When a crash causes a death, a separate rule applies. A Virginia wrongful death action is filed by the decedent’s personal representative within two years of the death (Va. Code §§ 8.01-50(C), 8.01-244(B)), on behalf of the family members the statute protects.

How much a log helps depends on the facts of each crash.
