When the crash injured or killed someone, a note left in place of a report to police does not meet Virginia’s duty.

Many drivers think a note on a windshield or a number handed to a bystander is a responsible step. The driver must stop, report the crash to police, and help the injured person.

The question usually comes up after a crash that looked minor, such as a bump in a parking lot or a small impact on a county road. Injuries are not always obvious at the scene.

The firm represents people hurt in car and commercial truck crashes, from the Shenandoah Valley to Richmond and Henrico County. Code §§ 46.2-371, 46.2-894). You can read the duty in Va. Code § 46.2-371, which requires immediate notice of the accident to a law-enforcement officer.

Va. Code § 46.2-894 adds detail. The driver gives name, address, driver’s license number and vehicle registration number to the State Police or a local law-enforcement agency. If the injured person appears able to understand it, the driver gives that information to that person too.

The statute also requires reasonable assistance. The driver must help an injured person, including taking that person to a physician, surgeon or hospital when medical treatment appears necessary or the person asks for it.

Here is a point people often mix up. The two-year period discussed later is the deadline to file a lawsuit, not the deadline to report a crash (Va. Code § 8.01-243).

Why a note left at the scene does not meet the reporting duty

The question of whether it is illegal in Virginia to leave a note after hitting someone often comes from drivers who feel they acted responsibly.

A note is not a report to police. The statute sends the report to the State Police or a local law-enforcement agency. A note left on a car or handed to a bystander reaches neither one.

A note also cannot do the work the statute expects at the scene. Officers need facts they can check, such as who was hurt, what happened and whether an ambulance is needed. Paper cannot answer questions. It cannot confirm that the injured person read it or got care.

The statute also covers a driver who is too injured to comply. In that case, the driver must make the report as soon as reasonably possible and make a reasonable effort to find the person struck. Leaving a note is different from making that effort.

Drivers who feel panicked still have to stop and report.

What the rules mean for people who were hurt by a driver who left

Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va. Code § 8.01-243(A)); the clock runs from the date of injury, not the date of discovery, with narrow exceptions. Section 8.01-243 of the Code of Virginia provides that, unless otherwise provided in this section or by other statute, every action for personal injuries must be brought within two years after the cause of action accrues (Va. Code § 8.01-243).

Some claims carry notice requirements that run out sooner, so the timing needs a close look early.

Crash evidence also matters. The Virginia DMV crash report page explains who may obtain a police crash report, which can help show what happened at the scene.

Injured people often face medical care, missed work and insurance letters at the same time. A person who was hurt may wish to speak with a lawyer about which deadlines and remedies apply to their facts.

When a death or a driver’s conduct raises additional rules

When a crash causes a death, Virginia uses a separate wrongful death action. A Virginia wrongful death action is filed by the decedent’s personal representative within two years of the death (Va. Code §§ 8.01-50(C), 8.01-244(B)), on behalf of the family members the statute protects. Family members do not file; they share in the recovery.

The filing rules appear in Va. Code § 8.01-50 and Va. Code § 8.01-244.

Virginia wrongful death damages cover the family’s sorrow, mental anguish and loss of the decedent’s companionship, guidance and care; lost income and services; medical expenses from the injury; funeral expenses; and, for willful or wanton conduct, punitive damages (Va. Code § 8.01-52).

Virginia allows punitive damages for actual malice, or for willful or wanton conduct or recklessness showing a conscious disregard for the safety of others, capped at $350,000 (Va. Code § 8.01-38.1). Under Virginia law, the jury must find that the conduct met this standard before punitive damages can be awarded.

Related questions on this guide

Short answers to common follow-up questions appear below.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Do I have to stay at the scene in Virginia?

Yes.
