They show when a driver was driving, resting, or on duty, and the carrier usually keeps them. Because carriers handle these records under their own practices, timing matters. This page explains what driver logs and electronic logging device (ELD) data record, why federal rules make them relevant, and why early action helps.

What Driver Logs and Electronic Logging Devices Record

A driver log is a record of a commercial driver’s duty status. An electronic logging device, or ELD, is the technology that captures much of that status automatically.

Federal rules require a motor carrier, except a private motor carrier of passengers (nonbusiness), to have each driver record duty status for each 24-hour period (49 C.F.R. § 395.8). The driver selects a status: off duty, sleeper berth, driving, or on-duty not driving (49 C.F.R. § 395.24).

The ELD also records data on its own. Under federal rules, it automatically captures the date, time, the truck’s location, engine hours, vehicle miles, and identification of the driver, vehicle, and carrier (49 C.F.R. § 395.26).

Not every truck uses an ELD. Federal rules allow some carriers to use paper logs in certain situations, so a company’s records may take different forms. Drivers also enter some information themselves and review their records before certifying them.

Not sure what your next step is?

Talk it through with Correll Law Firm — we can walk you through how a situation like yours is usually handled and what your options are.

Schedule a case evaluation

Schedule a case evaluation

Why Federal Hours-of-Service Rules Make These Records Relevant

Federal hours-of-service rules limit how long commercial drivers may drive and work, and logs show whether carriers follow them. The Federal Motor Carrier Safety Administration (FMCSA) publishes these rules, and its hours-of-service page describes the driving, work, and rest requirements.

A log can show whether a driver was on duty, driving, resting, or off duty at a given time. That is why a reviewer may line the log up against the crash timeline. The entries can match the crash clock, or they can leave gaps that need explaining.

Federal rules also bar any driver or carrier from making a false report about duty status (49 C.F.R. § 395.8). Whether a log shows a problem depends on the facts of the crash. A log that looks off does not prove what caused a crash on its own. The road, the weather, and the other vehicles involved are part of the same picture.

What Logs and ELD Data May Show After a Crash

After a crash, logs may show duty status, the times of status changes, and the name of the city, town, or village, with State abbreviation, where each change of duty status was recorded. Under 49 C.F.R. § 395.24(c), a driver using an electronic logging device (ELD) must manually input a description of the driver’s location when prompted by the ELD. An ELD can add records while the truck is moving. If the vehicle is in motion and nothing else has been recorded for an hour, the device creates an intermediate record (49 C.F.R. § 395.26).

Logs and the actual trip can differ. A driver may enter a status late, or an entry may be wrong. Federal rules require drivers to review their records, correct inaccurate entries, and certify them (49 C.F.R. § 395.30). Each change or addition must be annotated, so the edits leave a trail.

A log problem alone does not explain a crash. The records matter when they help show how the crash happened.

Why Early Preservation of Driver Logs and ELD Data Matters

Early preservation matters because carriers keep these records under their own retention practices, which can vary. Federal rules set some limits. A motor carrier must not alter or erase, or permit or require alteration or erasure of, the original hours-of-service information or the ELD data that uses it (49 C.F.R. § 395.30). A carrier must also retain for 6 months a backup copy of ELD records on a device separate from the one on which the original data are stored (49 C.F.R. § 395.22).

Still, the carrier generally holds these records, not the person who was hurt. A person hurt in a crash may not have access to them. A written preservation request asks the carrier to keep logs, ELD data, dispatch communications, and trip records in their current form. Sending one soon after a crash helps those records stay as they were.

The sooner a request is made, the less room there is for records to be handled under routine business practices. A preservation request asks a carrier to keep what already exists. It does not assume anything is wrong. Early steps help keep the evidence trail intact.

Crash Reporting Duties and the Timeline for Filing a Claim

Virginia requires a driver involved in a crash with injury or death to stop and report it to police immediately (Va. Code §§ 46.2-371, 46.2-894). The two-year period is the deadline to file a lawsuit, not to report a crash.

Virginia generally allows two years from the date of injury to file a personal injury lawsuit (Va. Code § 8.01-243(A)); the clock runs from the date of injury, not the date of discovery, with narrow exceptions. Some claims carry notice requirements that run out sooner.

The police report from the scene can also give a timeline. Its times and locations can be compared with the log’s entries. Records requested early can help keep that timeline organized while a claim develops. The reporting duty and the filing deadline are separate rules, and it helps to keep them apart.

Questions Readers Often Ask About Driver Logs in Virginia Truck Cases

Start with notes from the scene, since they help identify the carrier and driver for later record requests. Write down the company name on the truck, the USDOT number if it is visible, and the date and place of the crash. Photos of the truck’s markings can help too.

<details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Can a driver log be wrong?

Yes, a log can contain errors.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Are driver logs the only evidence after a truck crash?

No. Logs are one source of evidence among several, and each one is read in context.
</details><details class="wp-block-details chg-faq is-layout-flow wp-block-details-is-layout-flow">
Does living in Richmond or Henrico County change this?

The firm’s offices are in Winchester and Harrisonburg, and it serves people from the Shenandoah Valley to Richmond and Henrico County.
</details>

Driver logs and ELD data are one piece of a larger picture.
